Prepare a file that shows who paid, who received, why the amount became due and when payment was required. Any gap in that sequence may later become a disputed point.
Write the chronology before taking action
Set out the agreement, performance, invoice or payment request, partial payments and the latest communication in date order. This simple step usually reveals what the file is missing.
Start with what happened rather than describing the other party as evasive. Identify who signed, whether delivery occurred, what was disputed and when the objection first appeared.
Documents worth finding
A financial claim is not always built on one long contract. Evidence may consist of an accepted quote, invoice, bank transfer and a message acknowledging the amount. The documents must connect without guesswork.
- Contracts, schedules, purchase orders and accepted quotations.
- Invoices, delivery records, completion notices and payment certificates.
- Bank transfers and account records linked to the transaction.
- Emails and messages showing agreement, acknowledgment or objection.
- Earlier payment demands and proof of delivery where relevant.
Preserve digital conversations in context
WhatsApp messages and email can form part of digital evidence. A cropped screenshot is not the same as a conversation whose parties, date and context can be verified. Keep the original device or file and avoid edits that change context.
Identify the messages that establish agreement, delivery or acknowledgment. Hundreds of unstructured pages can hide evidence rather than strengthen it.
Substantive claim or enforcement?
The routes are different. A qualifying enforcement instrument may support direct enforcement. If the existence or amount of the right is disputed, a substantive claim may need to determine it first.
Jurisdiction also depends on the relationship and parties. An employment payment, a business invoice, a construction certificate and a personal loan do not follow one identical path.
Errors that weaken a valid claim
Check that names, capacities, contract numbers and amounts are consistent. Separate principal from compensation or additional costs and state the basis of each request clearly.
- Do not file in the name of a person or entity different from the documented party.
- Explain differences between contract, invoice and final amount.
- Check jurisdiction, arbitration clauses and statutory deadlines early.
Questions on this topic
Short answers before you begin.
Can WhatsApp messages prove a debt?+
They may form part of digital evidence if attribution, integrity and context can be verified. A related contract, transfer or delivery record usually makes the picture clearer.
Should a payment demand be sent first?+
It may be contractually required or useful to establish maturity and attempt resolution. Its wording and timing depend on the relationship and agreement.
What is the difference between judgment and enforcement?+
A judgment determines a disputed right. Enforcement compels performance under an enforceable instrument. Some files begin with a claim; others may proceed directly to enforcement.
